1.  "Association," "homeowner association," "HOA," and common-interest association are used interchangeably in the commentary on this site to mean all associations, both a condominium association of unit owners and a community association, regardless of the type of property (i.e., regardless of whether homes are built and whether the property is commercial or residential).

Bylaws and Articles of Incorporation in the Nonprofit Act.  Wherever the Nonprofit Act conditions something on the presence of a provision in the bylaws, the condition is satisfied if the provision is either in the bylaws or the articles of incorporation (and conversely, if the act conditions something on the absence of a provision in the bylaws, the condition is satisfied only if the provision is absent from both the articles of incorporation and the bylaws).  See Section 16-6a-202(6).  It is also generally presumed that in an HOA context, the condition is satisfied if the provision is in the declaration instead of the bylaws or articles, since the declaration is the document of highest authority for an HOA.  Alternatively, such a provision could be considered a bylaw, even though contained in the declaration, if adopted in a manner consistent with the act, because under the definition of bylaws in the act, it doesn't matter where a provision is located or what it's called in order to be considered a bylaw.

4.  "CC&Rs" and "declaration" mean a community association declaration and a condominium declaration.  The term "CC&Rs" is short for covenants, conditions and restrictions, or rather declaration of covenants, conditions and restrictions.  "CC&Rs" and "declaration" do not include bylaws.  Bylaws are a separate document with a separate purpose, although in condominiums they are sometimes embedded within a declaration (and if they are not, they must be attached to the condominium declaration).
