fire code (BBQs)

Utah has adopted the International Fire Code, 2021 edition (excluding appendices, as issued by the International Code Council, Inc., except as amended by Part 2, Statewide Amendments and Additions to International Fire Code Incorporated as Part of State Fire Code).  See Utah Code § 15A-5-103.

The International Fire Code states:

Charcoal burners and other open-flame cooking devices shall not be operated on combustible balconies or within 10 feet of combustible construction.
Exceptions:
1. One- & two-family dwellings,
2. Where buildings, balconies and decks are protected by an automatic sprinkler system.
3. LP-gas [a.k.a. propane] cooking devices having LP-gas container with a water capacity not greater than 2 1/2 pounds (nominal 1 pound (0.454 kg) LP-gas capacity).

International Fire Code, 2021 edition, Section 308.1.4.

What are one- & two-family dwellings?  Section 202 of the IFC defines a "dwelling" as "a building that contains one or two dwelling units used or occupied for living purposes." So, a one- or two-family dwelling is an independent, detached building with one or two dwelling units (commonly called single family homes and duplexes).  So detached single family homes and duplexes are exempt from this restriction but it applies to attached townhomes and condominiums with more than two units.

Statutes and Cases:

For reference: 57-8 is the Condo Act, 57-8a is the Community Association Act, 16-6a is the Nonprofit Act.
