Request for Association Records by Owner

Step-by-Step Guide to Requesting Records from Your HOA Pursuant to Utah Law

(Utah Code § 57-8-17 (condos), 57-8a-227 (community associations), and 16-6a-1601 et seq.)

Some key requirements of the law regarding records:

  • An owner is entitled to view, copy or receive copies of certain records of an association if the owner makes a written request that includes certain information.
  • The governing documents (declaration (CC&Rs), bylaws, rules, etc.), most recent approved minutes, and most recent budget and financial statement must be made available by the association to owners via the association’s website free of charge, or if the association doesn't have a website, at the association’s address registered with the Utah HOA Registry.
  • There are penalties if an association fails to fulfill a request (but an association is not liable for erroneous documents identified or produced in good faith).
