Religious and Holiday Displays
Utah law does not regulate how an association restricts or prohibits religious displays and holiday decorations in the recorded CC&Rs (a.k.a, the declaration). But, the law does regulate how a board restricts or prohibits such displays and decorations in rules, as follows:
Community Associations. A rule may not restrict religious or holiday signs, symbols, or decorations on an individually-owned and -maintained lot, including a home exterior that the owner maintains and a front yard that the owner owns and maintains. A rule may restrict such displays and decorations in areas that the association owns or maintains. Additionally, a rule may restrict when, where, and how those items are displayed outside a dwelling and if visible from outside the lot.
Condo Associations. A rule may not restrict religious or holiday sign, symbol, or decoration displayed inside a unit, but an association may restrict when, where, and how those items are displayed if visible from outside the unit.
